Article 2, clause 4. "The Congress may determine the Time of chusing the Electors, and the Day on which they shall give their Votes; which Day shall be the same throughout the United States." There is no legal argument here. Electors are chosen by popular vote on the federal election date set by Congress. Could not be more clear. No ballot received after midnight after the designated election date is valid - and any state doing so is guilty of violating the plain language of the text. DEMs probably do NOT want this to go to SCOTUS.
